JOB SUMMARY: This professional position has responsibility for providing accurate and timely legal advice to the Contract Performance Management Unit, subject to such general or special instructions as the Hon. Attorney General may give in accordance with section 41 of the Constitution, primarily in relation to PPP contracts and issues impacting on the Contract Performance Management Unit (CPIVIU) and efficient representation where necessary. The Commercial Legal Counsel/TCIG Representative is expected to generate satisfactory results when the legal advice provided is credible and rarely results in litigation against the government; and agreements negotiated are favourable to the development of Turks and Caicos Islands. KEY DUTIES AND RESPONSIBILITIES:
General advice pertaining to legal implications of clinical service delivery, policy or procedure and health laws in the TCI.
QUALIFICATIONS AND EXPERIENCE: Qualifications: This position requires a Bachelor of Laws or its equivalent. In addition to a Bachelor of Laws the position requires that the job holder possess a Legal Profession Certificate or its equivalent as well as specialized training in legal issues and criminal law, commercial law, civil law and/or legislative drafting, and is called to the bar in the Turks and Caicos Islands or another Commonwealth jurisdiction in accordance with the requirements for admission under the Legal Profession Ordinance. Experience: The position requires at least ten (10) years on the job experience to acquire the necessary competencies to effectively respond to the challenges of the functions. The experience should span: Health, General Corporate and Commercial Law ø Litigation and Dispute Resolution. Civil practice and procedure a Drafting of Contracts and Pleadings, Commercial policies and procedures Litigation in the Courts (Magistrate Court, Supreme Court and Court of Appeal) The industry experience most appropriate for the job holder comprise, Commercial Law practice, Health Care and The Court system.
