JOB SUMMARY:

This professional position has responsibility for providing accurate and timely legal advice to the Contract Performance Management Unit, subject to such general or special instructions as the Hon. Attorney General may give in accordance with section 41 of the Constitution, primarily in relation to PPP contracts and issues impacting on the Contract Performance Management Unit (CPIVIU) and efficient representation where necessary. The Commercial Legal Counsel/TCIG Representative is expected to generate satisfactory results when the legal advice provided is credible and rarely results in litigation against the government; and agreements negotiated are favourable to the development of Turks and Caicos Islands.

 KEY DUTIES AND RESPONSIBILITIES:

1. This position is responsible for ensuring compliance with all contracts regarding the provision Of Health Services in the TCI.
2. Must have proficient knowledge and understanding of the major Health Care contracts.

General advice pertaining to legal implications of clinical service delivery, policy or procedure and health laws in the TCI.

4. Provide advice on claims, complaints or litigation involving health care and services.
5. Representing Ministry of Health in relation to complaints and procedure with regulatory authorities,
6. Work With the Attorney General's Chambers on litigious matters involving the Ministry of Health.
7. Draft legal opinions for the Ministry of Health on matters concerning health care and delivery of services.
8. Drafting health care and services agreements.
9. Respond to legal queries made by government departments.
10. Provide legal advice to all government departments.
11. Monitor all work done in the respective Division.
12. Conduct seminars and train personnel in government departments on legal issues regarding Health Care and Services.
13. Assist in the development of new legislation and the review or amendment of old legislations.
14. Adhere to all Public Service codes, rules and regulations.

QUALIFICATIONS AND EXPERIENCE:

Qualifications:

This position requires a Bachelor of Laws or its equivalent. In addition to a Bachelor of Laws the position requires that the job holder possess a Legal Profession Certificate or its equivalent as well as specialized training in legal issues and criminal law, commercial law, civil law and/or legislative drafting, and is called to the bar in the Turks and Caicos Islands or another Commonwealth jurisdiction in accordance with the requirements for admission under the Legal Profession Ordinance.

Experience:

The position requires at least ten (10) years on the job experience to acquire the necessary competencies to effectively respond to the challenges of the functions.

The experience should span:

Health, General Corporate and Commercial Law ø Litigation and Dispute Resolution.

Civil practice and procedure a Drafting of Contracts and Pleadings, Commercial policies and procedures Litigation in the Courts (Magistrate Court, Supreme Court and Court of Appeal)

The industry experience most appropriate for the job holder comprise, Commercial Law practice, Health Care and The Court system.

Compensation:

Grade 9.1 $61,934.60 per annum
