Fundamental Rights and Freedom

  • Fundamental Rights and Freedoms of the Individual – It is the right of every person in the Turks and Caicos Islands to be treated fairly.
  • Protection of Right of Life – life is essential for you to enjoy your rights and can only be taken away in limited law circumstances.
  • Protection from Inhuman Treatment – Every person has the right to live without fear of being tortured or treated cruelly or brutally.
  • Protection from Slavery and Forced Labour – No one should be held captivity or bondage slavery like a slave.
  • Protection from Arbitrary Arrest or Detention – Your Freedom must be protected.
  • Provisions to Secure Protection of Law – If a person is arrested and tried for a criminal offense, the authorities must obey the rules set out, which aim to ensure the person gets a fair trial.
  • Protection of the Right of Prisoners to Human Treatment – If you are sent to prison, you must still be treated properly.
  • Protection of Private and Family Life and Privacy of Home and Other Property – No one is allowed to interfere with your private or family, or your home, unless certain conditions are met.
  • Protection of Right to marry and found a Family – A man or woman has the right to marry person of the opposite sex, once they are of the right age to do so and to start a family.
  • Protection of Freedom of Conscience and of Religion – A person has the right to their freedom of conscience.
  • Protection of right to Education – A person the right to access the educational system.
  • Protection of Freedom of Expression – A Person has the right to hold and receive a broad range of views, beliefs, thoughts and opinions and to express their views and ideas on the own or in a group with interference.
  • Protection of Freedom of Assembly and Association – A person has the right to hold meetings part of group, association or organization in a peaceful way.
  • Protection of Freedom of Movement – Once you live in the Turks and Caicos Islands, you have the right to move around freely go anywhere on the island, live anywhere on the island etc.
  • Protection from Discrimination - No person should be treated differently because of his or her race, color, etc.
  • Protection from Deprivation of Property – If you think that any of your rights have been denied or violated, you can take the matter before the court.
  • Protection of the Environment – The Legislative and government shall, in their decisions, have due regard to the needs to foster and protect an environment that is not harmful to the health or well-being of present and future generations, etc.
  • Lawful Administrative Action – All decisions and acts of the government on its behalf must be lawful, rational, proportionate and procedurally fair.
