Labour Clearance
Before being granted a valid work permit, potential employees must first be granted Labour Clearance. This step ensures only those qualified for employment in the TCI are reviewed for work permits. To apply for Labour Clearance the following are required:
New Applications
- Covering letter
- Completed and signed Work Permit Application Form
- Copy of applicant’s passport photo page
- Copy of advertisement of position in two consecutive issues of a local newspaper
- Medical Certicate and Police Record of within six months
- Copy of current Business License
- Completed Employment Contract in accordance with Employment Ordinance 2004
- Photo identication of employer or Business License
- Proof that every effort was made to recruit a Belonger
Renewal of Work Permit
- Covering letter
- Original Work Permit card
- Copy of applicant’s passport photo page
- Medical Certicate and Police Record of within six months
- Copy of advertisement of position in two consecutive issues of a local newspaper
- Proof of legal immigration status as regards the Islands
- Copy of employer’s photo identication or current Business License
Newspaper advertising referred to above should include:
- A description of the job to be done:
- The Wages/Salary attached to the position
- A description of a suitable person:
- The person to contact:
- Time within which to contact that person:
- A modern method by which the person may be contacted:
- What to expect when contact is made:
- Time when the position will become available:
For Agencies & Consultancies
- All requirements of application for New or Renewal
- Intent letter signed by prospective employer
- Signed contract between Agency and User Enterprise
Application Process - Approximately two weeks for all applications
We use the following criteria to decide whether Labour Clearance should be provided:
- Is there is a need for this position?
- Is there a Belonger who is suitable and available to take this position?
- Employer's legal status in the Islands: business owner or manager, holder of PRC or Belongership certificate.
- Has this employer cooperated with the Ministry in recent dealings?
- Authenticity of medical certificate: official stamp, verify signature, tests checked off, date.
- Is this application for: Temporary, Renewal, Transfer or New?
- If New: Is the person in the Islands?
- If Yes: is he/she on a Temporary work permit, endorsed on a relative's permit, on a resident permit, or can show an Immigration entry stamp or extension good to today's date.
