END OF BUSINESS LICENSE RENEWAL AND PERIOD OF AMNESTY

The Revenue Department would like to remind the business community that the extension Business Licence Renewal Period for 2022/23 is nearing its end.  Payment for renewal must be made on or before Thursday, June 30th, 2022 to avoid penalties of 10% per month.

 

Similarly, June 30th, 2022 marks the end of the Amnesty which permits licence holders who have accrued penalties on licenses which were not renewed for the fiscal years 2018/2019, 2019/2020, 2020/2021 and 2021/2022 to contact the Department to receive a waiver. Failure to take advantage of the Amnesty period will result in the penalties being reinstated and will once again become due and payable as of 1st July, 2022.

 

Businesses that have ceased to operate and held a Business Licence are encouraged to notify the Inland Revenue Department immediately of such change in order to avoid penalties.  All businesses that made or are making changes to their business structure, location, etc. must give written notice to the Inland Revenue Department.

 

Business License applicants are reminded and advised that a paid receipt is not proof of licensing and approval must first be obtained through the Inland Revenue Department in the form of the prescribed Business License Certificate.

CONDITIONAL MORATORIUM ON THE ISSUANCE OF CONTRACTORS LICENSES

MINISTRY OF FINANCE, INVESTMENT & TRADE PLACES A CONDITIONAL MORATORIUM ON THE ISSUANCE OF BUSINESS LICENSES IN THE CONTRACTORS CATEGORY 

The Turks & Caicos Islands Government in an effort to undertake a comprehensive assessment of the contractors licensing category, has placed a six (6) month moratorium on the issuance of all new business license in the contractor category where the applicant is a non- Turks & Caicos Islander or in the case of a partnership or company where any shares are held by a non-Turks and Caicos Islander. 

 

 

Does this apply to renewals?

No, the moratorium does not apply to existing license holders only new applications.

 

Can I apply for a new license in this category?

Yes, however this is limited to Turks & Caicos Islander Status Holders only. In the case of a partnership all partners must be Turks & Caicos Islander Status Holder. Companies must also demonstrate that all shareholders in the company are Turks & Caicos Islander Status Holders.

‘Business Licence Amnesty Period for the Waiver of Penalties’

 

The Inland Revenue Department (IRD) within the Ministry of Finance, Investment & Trade would like to inform the public that the House of Assembly at its sitting on 28th March, 2022 passed the Business Licensing (Fees and Penalties) (Amnesty) Ordinance 2022 (hereinafter the Ordinance).  

 

The Ordinance permits licence holders who have accrued penalties on licences that were not renewed for the periods:

 

  • 2018/2019;
  • 2019/2020;
  • 2020/2021; and
  • 2021/2022.

 

 

to benefit from a waiver. In order to qualify for the waiver, the outstanding fees are to be paid before the end of the Amnesty period which is from 1st April, 2022 to 30th June, 2022. Should the fees not be paid during the Amnesty period, the penalties will be revived and will once again become due and payable as of 1st July, 2022.

Unfortunately, the E-Services platform cannot be used to facilitate renewals for those licensees that wish to benefit from the Amnesty Waiver.
