Amendment to National Physical Development Plan - Water Cay

Purpose of Revocation or Amendment

In accordance with powers conferred on the Director of Planning under section 37 of the Physical Planning Ordinance of the Turks and Caicos Islands, the Director of Planning gives notice of modification of the National Physical Development Plan in respect of Water Cay to take account of contractual obligations in respect of parcels of land which were previously transferred from the Crown.

The Plan came into effect on the 1st of October 2021; subsequently to the enactment date an error was discovered in the plan which refers to Water Cay to continue to be an uninhabited island.

Cabinet at its meeting on the September 7th 2022 granted approval for the Ministry of Physical Planning to follow Section 37 of the Physical Planning Ordinance in relation to errors noted in the National Physical Development Plan.

Proposed Amendments

“The NPDP states at the 2nd paragraph on page 376 and the Vision,“Water Cay will continue to be an uninhabited island” and the last bullet on page 379 “Water Cay and Little Water Cay should be maintained and studied for environmental protection and sustainability.”

Page 376 2nd paragraph reads:

In the mid 2000s a large resort and marina was planned or the island and had progressed to early planning stage before it stalled due to the 2008 economic crash. There are no utilities on the island although the Fortis HV submarine cable runs just south of the island.

Vision

Water Cay will continue to be an uninhabited island, and Little Water Cay will continue to be a protected haven for iguanas. The island and its amenities will be used by the general public.

This section should be amended to read:

In the mid 2000s a large resort and marina was planned for the island and had progressed to early planning stage before it stalled due to the 2008 economic crash. The Development Agreements in respect of this have now been terminated. In April 2018 the parties agreed that in respect of the parcels of land which were transferred pursuant to the Development Agreements, subject to certain exclusions, the Land Use Plan (therein defined) will serve as a guide to the likely future use of the Land. The future development will be subject to application for planning and other appropriate permissions which shall be considered in accordance with the environmental and other policy, good practice and development standards applicable at the time of application. There are no utilities on the island although the Fortis HV submarine cable runs just south of the island.

Development on Water Cay may be considered in accordance with existing contractual obligations, and Little Water Cay will continue to be a protected haven for iguanas. The remaining Crown parcels on the island and its amenities will be used by the general public.”
